As part of our recruitment process, Slater Builders (“we,” “our,” “us”) collects and processes information relating to job applicants (“Personal Information”). We are committed to being transparent about how we collect and use that Personal Information and to meeting our data protection obligations.
This Privacy Policy explains how we collect, use, and share the Personal Information that we gather as part of the recruitment process. A reference to “Slater Builders,” “we,” “our,” or “us” is a reference to Slater Builders and our relevant affiliates, if any, involved in the collection, use, sharing, or other processing of Personal Information.
1. What Personal Information do we collect?
We collect the following categories of Personal Information:
- Identifiers, such as name, telephone number, email address, postal address, date of birth, driver’s license number or state identification card number, or other similar identifiers.
- Personal information under California Civil Code section 1798.80(e), such as name, signature, address, telephone number, driver’s license or state identification number, education, employment, or employment history.
- Characteristics of protected classifications under state or federal law, such as citizenship status, age, or gender.
- Professional or employment related information, such as a resume, current and previous employment details, work authorizations, or immigration status.
- Education information, such as education background, university or school diplomas/certificates, and other educational achievements.
- Inferences, such as job preferences or willingness to travel and/or relocate.
- Internet or other electronic network activity information, such as documents, files, or other information you send through our application portal.
We also collect the following categories of sensitive Personal Information:
- National identification numbers, such as social security number, driver’s license, state identification card, or passport number.
- Other sensitive information, such as citizen or immigration status, or union membership.
We may collect Personal Information in a variety of ways. For example, Personal Information may be contained in application forms, CVs or resumes, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment. We may also collect Personal Information from third parties, such as background checks and references supplied by former employers.
Data will be stored in a range of different places, including in your application record, our HR management systems, or other IT systems (including email).
In addition, where relevant to the recruitment process, including where necessary to accommodate any disability needs or to comply with some regulatory requirements, we may also have the need to process sensitive Personal Information, such as characteristics of protected classifications. This may include:
- Race, color, ancestry, national origin (including languages used and proficiency)
- Religion, creed, political affiliations or activities
- Age (40 and above)
- Mental and physical disabilities
- Sex and gender, including pregnancy, childbirth, breastfeeding or related medical conditions
- Sexual orientation, gender identity, and gender expression
- Medical condition, AIDS/HIV status
- Genetic information
- Marital status
- Military and veteran status
- Criminal records, in certain circumstances
- Victims of domestic abuse and/or assault/stalking
2. How do we use your Personal Information?
We will use your Personal Information for the following purposes:
- To process your application, including to identify and contact you;
- To determine whether you have the professional skills, expertise, and experience for the position applied for;
- If you are offered a position with us, to verify the Personal Information provided, including your identity, address, right to work, employment history and academic background, and for other background screening purposes, including, where allowed by law, criminal record checks, searches with a credit reference agency, and sanctions screening checks;
- To understand and accommodate your disability needs;
- To detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or to prosecute those responsible for that activity;
- For compliance, disciplinary, legal and regulatory purposes; and
- For business reasons that facilitate the operation of our business.
We may also deidentify, aggregate, or otherwise strip personally identifiable characteristics from your Personal Information. We reserve the right to use such data for our own purposes.
We may collect additional categories of Personal Information for other business-related purposes and/or use Personal Information collected for additional purposes, upon prior written notice to you.
3. Who has access to your Personal Information?
Your Personal Information may be shared internally for the recruitment purposes and for other purposes described in this Privacy Policy. This includes, but is not limited to, sharing your Personal Information with members of Slater Builders, interviewers involved in the recruitment process, managers in the business area with a vacancy, and any support staff needed to ensure you can perform the intended role.
If your application for employment is successful and we make you an offer of employment, we will then share your Personal Information with former employers to obtain references for you and share with employment background check providers to obtain necessary background checks.
In the event of a change of control or ownership of Slater Builders, or in the event that all or part of our business is otherwise transferred to a third party, your Personal Information may be transferred to that third party, subject to applicable law.
4. Retention and security of your Personal Information
Your Personal Information shall be retained and destroyed according to our document retention policy and in compliance with applicable laws and regulations. If your application for employment is successful, your Personal Information will be transferred to your human resources file and retained in accordance with our employee retention policies.
We employ internal security policies and controls to help prevent the unauthorized access and disclosure of your Personal Information.
5. Privacy rights and additional disclosures for Californians
California provides state residents with certain rights for their Personal Information. We provide the following information to help you understand these potential rights. If you would like to exercise any rights or inquire as to whether such rights are available to you, please contact us using the contact details at the end of this Privacy Policy.
Request for Information or Deletion. Californians have the right to know whether we are processing your Personal Information, and in some cases, the right to request that we disclose to you the categories listed below for the preceding 12 months. In responding to this right, we shall provide you:
- The categories of Personal Information we collect about you.
- The categories of sources from which your Personal Information is collected.
- The business or commercial purpose(s) for collecting, selling, sharing, or disclosing your Personal Information, and the categories of Personal Information disclosed for such purpose(s).
- The categories of third parties with whom we share your Personal Information.
- The categories of Personal Information we have sold, if any, about you and the categories of third parties to whom your Personal Information was sold, by category or categories of Personal
- Information for each third party to whom the Personal Information was sold.
- The specific pieces of Personal Information we have collected about you.
In addition, you may have the right to request we delete your Personal Information.
Request for Correction. Californians have the right to request the correction or rectification of inaccurate information in their Personal Information.
Do Not Sell or Share My Personal Information. Californians have the right to opt out of the sale or sharing of their Personal Information. However, we do not sell your Personal Information, nor do we share your Personal Information to provide personalized or targeted advertising.
Limiting the Use of Sensitive Personal Information. Californians have the right to direct us to use or disclose sensitive Personal Information only for providing goods or services, or as otherwise minimally permitted under applicable law. However, we do not use or disclose sensitive Personal Information for any purpose other than for recruitment purposes disclosed herein, or as otherwise minimally permitted under applicable law.
Right of Non-Retaliation. Californians have the right not to be retaliated against for exercising any of these rights.
Verification Process for Exercising Rights. To protect your privacy, we verify privacy rights requests to ensure that only you (or your authorized agent) can exercise rights pertaining to your Personal Information. As part of our verification process, we may request you submit additional information.
If you are an authorized agent wishing to exercise rights on behalf of a California state resident, please contact us using the information at the bottom of this Privacy Policy and provide us with a copy of the resident’s written authorization designating you as their agent. We may need to verify your identity and place of residence before completing your rights request.
6. What if you do not provide Personal Information?
You are under no statutory or contractual obligation to provide Personal Information to us during the recruitment process. However, if you do not provide certain Personal Information, we may not be able to process your application properly or at all.
7. Changes to this Privacy Policy
The date this Privacy Policy was last updated is located at the top of this Privacy Policy. We may update this Privacy Policy from time to time. We encourage you to review this Policy carefully before submitting Personal Information to us.
